What is the legal limit for alcohol concentrations? |

In Kentucky, the prosecution must prove that someone was operating a motor vehicle while under the influence of alcohol or another substance in order to get a conviction for DUI. The legislature has set a per se limit of .08 blood alcohol concentration to prove someone is under the influence. It is possible for a to be convicted with a lower BAC if it is proven that the accused was operating the motor vehicle while impaired. The limit set by the legislature is important becasue If the his or her BAC is above .08 then it is assumed that he or she was impaired.
