In Kentucky,a person is presumed to be under the influence if their BAC is .08 or higher. However, a person under the age of 21 can be conviceted if they have a BAC of .02 or more.

Why hire an attorney if my BAC was above the legal limit?

A person charged with DUI should always consider having an attorney look at their case as soon as possible. Often times proper procedure maynot have been followed by the officer when the arrest was made. This can lead to suppresion of the evidence that would be used agains the person charged.

In addition, an attorney can sometimes negotiate with the prosecution to obtain a lesser sentence.
